Deutsch: Causa: Der Architekt Oskar Neumann, geboren 1870, lebte mit seiner Frau Therese in der Himmelstraße 43. Deren Sohn Georg war gleich alt wie Rudolf Leopold, der in unmittelbarer Nähe (Cobenzlgasse 16) aufwuchs. Die beiden sollen sich gekannt haben. Neumann besaß eine umfangreiche Kunstsammlung (darunter 158 Ölgemälde), die im September 1938 im Zuge eines Ansuchens um Ausfuhrbewilligung nach Paris erfasst wurde. Drei Bilder von Albin Egger-Lienz befanden sich zu jener Zeit nicht in Wien: Noch vor dem "Anschluss" hatte Neumann Die Bergmäher, Mann und Weib sowie Totentanz für eine Ausstellung nach Klagenfurt verliehen. Dort wurden sie im Oktober 1938 "sichergestellt". Die Gauleitung erwarb Mann und Weib und schenkte das Bild Hitler zum 50. Geburtstag: Es befindet sich nach wie vor in der Kärntner Landesgalerie - als einstige "Leihgabe des Führers". Zur Flucht kam es nicht: Neumann übertrug sein Eigentum an seine Frau, eine "Nichtjüdin", sowie seinen Sohn und ließ sich anglikanisch taufen. Er starb im Oktober 1951. Leopold kaufte Die Bergmäher 1970 in der Galerie Schebesta.
Conclusio Graf: Leopold erwarb derivativ Eigentum. Da es sich aber um ein entzogenes Kunstwerk handelt, wäre es bei einer Ausdehnung des Rückgabegesetzes zu restituieren. Diese Angaben stammen aus einem Gutachten der Israelitischen Kultusgemeinde. Das Gutachten wurde kritisiert, da die rechtlichen Schlussfolgerungen auf von der IKG vorgegebenem Datenmaterial basieren. |
